Terms of Service
TERMS OF SERVICE
(AnomalousDesigns.com and photos.anomalousdesigns.com)
Last updated: July 28, 2026 | Effective date: July 28, 2026
1. Who We Are & Acceptance
These Terms of Service ("Terms") govern your access to and use of AnomalousDesigns.com and photos.anomalousdesigns.com ("Anomalous Photos"), together with all related pages, features, client galleries, booking tools, and services (collectively, the "Services"), operated by Anomalous Designs LLC ("Anomalous Designs," "AD," "we," "us," or "our"), a limited liability company based in Boise, Idaho, USA.
By accessing or using the Services, creating an account, booking a session, opening a client gallery link, or making a purchase, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services. If you are using the Services on behalf of a business, you represent that you are authorized to bind that business.
2. Our Services
Anomalous Designs is a creative studio offering brand identity, engineering, fabrication, photography, web/software, marketing, consulting, and education services. Anomalous Photos is our photography platform, which includes a public portfolio (artist pages, collection grids, and image viewing) and private client galleries (accessed through unique links, with photo-selection tools, checkout, and downloads).
Detailed scope, deliverables, timelines, and pricing for any project or shoot are set out in a separate proposal, invoice, or service agreement. If a separate signed agreement conflicts with these Terms, the signed agreement controls for that engagement.
3. Eligibility & Minors
The Services are intended for users that are at least 18 years old, or the age of majority in their jurisdiction. The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. See our Privacy Policy for details. If a minor is to be photographed, a parent or legal guardian must book, consent, and sign any applicable release.
4. Accounts & Client Gallery Access
Some features require an account or a private gallery link. Client galleries are accessed through unique token links that are personal to you. You are responsible for keeping your gallery link and any login credentials confidential, and for all activity that occurs through them. Do not share your private gallery link with unauthorized parties. Notify us promptly if you believe your link or account has been compromised. We may suspend or terminate access for violations of these Terms.
5. Booking & Appointments (Cal.com)
Appointments — including 15-minute headshot sessions and business photography shoots — are booked through our scheduling provider, Cal.com. When you book, you agree to provide accurate information and to the following:
- Headshot campaign: A headshot session is offered for a flat fee of $50 for a 15-minute session. Payment is collected in full at the time of booking through Stripe.
- Free business photography campaign: Qualifying Treasure Valley businesses may receive a complimentary photo shoot with no obligation to purchase. After the shoot, photos are offered on a tiered pay-per-photo basis; you are under no obligation to buy, but all images remain the property of Anomalous Designs (see Section 8).
- Cancellations & rescheduling: Please give at least 24 hours' notice to reschedule or cancel a booked session. Cancellations or reschedule requests made with less than 24 hours' notice may forfeit any fee paid.
- Late arrivals: Sessions are time-limited. If you arrive more than 30 minutes late, your session will be automatically canceled and no refund will be issued.
We may reschedule for weather, equipment, illness, or other circumstances beyond our control. Your use of Cal.com is also subject to Cal.com's own terms and privacy policy.
6. Payments & E-Commerce (Stripe)
Payments for sessions, photo purchases, and other services are processed by our third-party payment processor, Stripe, Inc. By making a payment, you agree to Stripe's Terms of Service and Privacy Policy. We do not receive or store your full payment card number; card data is handled directly by Stripe.
- You agree to pay all fees and applicable taxes for the products or services you purchase.
- Prices are in US dollars unless stated otherwise.
- You represent that you are authorized to use the payment method you provide.
- Photo prices, including tiered pay-per-photo pricing under the business campaign, are as displayed at the time of purchase.
- We reserve the right to correct pricing errors and to refuse or cancel orders in cases of suspected fraud or error.
7. Digital Products, Downloads & Refunds
Purchased photos are delivered as digital files through expiring, signed download links. You are responsible for downloading and backing up your files before links expire. We can re-issue an expired link for a reasonable period on request, but we do not guarantee indefinite availability.
Because photographs are digital goods delivered electronically, all sales are final and non-refundable once a download has been made available or a signed download link has been issued, except in cases of duplicate charges or verified technical error. Headshot campaign session fees are also non-refundable once collected, including where a session is auto-canceled due to a late arrival as described in Section 5. If you experience a problem with a download, contact us and we will work in good faith to resolve it.
8. Intellectual Property & Image Licensing
This section is central to how photography works with Anomalous Designs. Please read it carefully.
8.1 Our ownership. Anomalous Designs LLC owns and retains all copyright and other intellectual property rights in all photographs, images, and creative works we produce, including all photos taken during client sessions (whether or not you purchase them), all previews, and all portfolio content. Under US copyright law, the photographer owns the copyright in an image by default; nothing in these Terms transfers copyright to you unless we expressly agree in a separate signed writing.
8.2 Our right to use photos. Anomalous Designs retains the full right to use, reproduce, display, publish, and distribute any photos we take — including client session photos — for our own marketing, portfolio, promotional, educational, and business purposes, across any media now known or later developed. By booking a session or being photographed, you grant us this right. If a session involves identifiable individuals, we may ask you (or a parent/guardian for a minor) to sign a separate model release; where you decline, you should tell us in writing and we will discuss reasonable limits.
8.3 What you receive. When you purchase or select photos, we grant you a limited, non-exclusive, non-transferable license to use those specific purchased photos for the purpose described at checkout or in your service agreement (for example, personal use, or business/commercial use for headshots and business photography). Unless your agreement says otherwise:
- The license covers only the specific images you purchase or select — not the full set of images from your session.
- You may not sub-license, resell, or redistribute the images as stock or to third parties.
- You may not claim authorship or remove our copyright or watermark information.
8.4 Re-sharing published content. You may repost and share any image that Anomalous Designs has already published publicly (for example, on our portfolio or social media), provided you do not alter it in a misleading way, do not remove any credit or watermark, and do not use it to imply a false endorsement. We appreciate credit to "Anomalous Designs" when you share.
8.5 Watermarked previews. Preview images shown before purchase are watermarked and are provided for selection only. You may not remove, crop out, or obscure watermarks, screenshot and use previews commercially, or otherwise use un-purchased images. Removing copyright management information (including watermarks) may violate the Digital Millennium Copyright Act (DMCA).
8.6 Website content. All other content on the Services — including text, logos, the "Anomalous Designs" and "Anomalous Photos" names, graphics, code, and design — is owned by Anomalous Designs or its licensors and is protected by intellectual property laws. You may not copy, scrape, reproduce, or create derivative works without our written permission.
9. Copyright Complaints (DMCA)
We respect intellectual property rights. If you believe content on our Services infringes your copyright, contact us at Howdy@AnomalousDesigns.com with: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (f) your physical or electronic signature.
10. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms;
- Access private galleries or links you are not authorized to access;
- Copy, download, scrape, or redistribute images (including watermarked previews) except as permitted;
- Attempt to bypass watermarks, access controls, expiring links, or security features;
- Upload malicious code, spam, or infringing/unlawful content;
- Harass, abuse, or harm others, or misrepresent your identity;
- Interfere with or disrupt the Services or the servers/networks that host them.
11. Third-Party Services & Links
The Services rely on and link to third-party providers, including Base44 (hosting/platform), Stripe (payments), Cal.com (booking), and Kit/ConvertKit (email). Our related Shopify store at Shop.AnomalousDesigns.com operates under its own separate Shopify-provided terms and privacy policy. We are not responsible for the content, terms, or practices of third-party services, and your use of them is at your own risk and subject to their terms.
12. Disclaimers
THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, secure, or error-free, that download links will always be available, or that colors/output will exactly match your display or expectations. Creative and artistic services are inherently subjective; we do not warrant that you will be satisfied with a particular artistic result.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANOMALOUS DESIGNS LLC AND ITS OWNERS, MEMBERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Anomalous Designs LLC from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, your violation of these Terms, your violation of any law or third-party right, or your use of purchased images outside the license granted.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Idaho, without regard to conflict-of-laws rules. You agree that any dispute arising out of or relating to the Terms or the Services will be resolved exclusively in the state or federal courts located in Ada County, Idaho, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us to attempt to resolve the dispute informally.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the revised Terms.
17. Termination
We may suspend or terminate your access to the Services at any time for violation of these Terms or for any lawful reason. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

Last updated: July 28, 2026 | Effective date: July 28, 2026
1. Introduction
This Privacy Policy explains how Anomalous Designs LLC ("Anomalous Designs," "we," "us," or "our"), a limited liability company based in Boise, Idaho, USA, collects, uses, shares, and protects personal information when you use AnomalousDesigns.com and photos.anomalousdesigns.com ("Anomalous Photos") (together, the "Services"). By using the Services, you agree to this Policy.
Our separate Shopify store at Shop.AnomalousDesigns.com is governed by its own Shopify-provided privacy policy; this Policy does not cover that store.
2. Information We Collect
Information you provide directly:
- Contact and identity information: name, email address, phone number, business name, and mailing address when you contact us, book a session, or sign up.
- Booking information: session type, date/time, and details you provide when scheduling through Cal.com.
- Payment information: processed by Stripe. We receive confirmation and limited billing details (such as name, email, and transaction records), but we do not receive or store your full card number.
- Photos and selections: images we take of you during sessions, and the selections, favorites, and choices you make in your client gallery.
- Newsletter signup: your email address (and any name you provide) when you subscribe to our newsletter through Kit/ConvertKit.
- Communications: the content of emails and messages you send us.
Information collected automatically:
- Basic technical data such as IP address, browser type, device information, and pages viewed, which may be collected by our hosting platform (Base44) and other providers to operate and secure the Services.
- Cookies that are strictly necessary to operate the Services, such as those that keep you logged in, maintain your gallery session, and process secure checkout. We do not currently use any analytics, advertising, or other non-essential tracking cookies or pixels. If that changes, we will update this Policy before doing so.
We do not intentionally collect sensitive personal information beyond what is necessary to provide our services. Please do not send us Social Security numbers, health information, or other sensitive data unless we specifically request it.
3. How We Use Your Information
We use personal information to:
- Provide, operate, and improve the Services;
- Schedule and conduct photography sessions and other services;
- Process payments and deliver purchased photos;
- Communicate with you about bookings, purchases, and support (transactional emails);
- Send you our newsletter and marketing emails if you have subscribed (you can unsubscribe at any time using the link in every email);
- Display and promote our work in our portfolio and marketing, consistent with our Terms of Service (Anomalous Designs retains rights to photos it takes);
- Maintain security, prevent fraud, and enforce our Terms;
- Comply with legal, tax, and accounting obligations.
4. How We Share Your Information
We do not sell your personal information. We share it only as needed to run our business:
- Service providers (data processors): We share information with trusted third parties that provide services to us, each acting under its own privacy commitments:
- Base44 — website/app hosting and platform infrastructure.
- Stripe, Inc. — payment processing; Stripe may collect transaction and device/behavioral data for fraud prevention and acts as our processor for payments.
- Cal.com — appointment scheduling.
- Kit (formerly ConvertKit) — newsletter and email delivery.
- Legal and safety: We may disclose information if required by law, subpoena, or valid government request, or to protect our rights, safety, or property.
- Business transfers: If we are involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction.
5. Photos, Images & Your Likeness
Because we are a photography business, images are a special category of personal information. Anomalous Designs retains ownership and full rights to all photos it takes, including client session photos, for its marketing, portfolio, and promotional use, as described in our Terms of Service. If you have concerns about the use of images in which you are identifiable, contact us and we will discuss reasonable options; where required, we will use a separate model release. Watermarked previews are shown before purchase to protect our images.
6. Cookies & Tracking Technologies
The Services use cookies and similar technologies that are strictly necessary for the site to function — for example, to keep you logged in, maintain your gallery session, and process secure checkout. Third-party providers such as Base44, Stripe, and Cal.com may set cookies needed to deliver their features.
We do not currently use analytics, advertising, or other non-essential tracking technologies (such as Google Analytics or the Meta Pixel) on our Services. If we begin using any such tools in the future, we will update this Policy to describe them and, where required, provide a cookie consent option before they are activated.
You can control cookies through your browser settings; disabling some cookies may affect how the Services work.
7. Data Retention
We keep personal information for as long as needed to provide the Services and for legitimate business and legal purposes:
- Client and booking records: kept for the duration of our relationship and afterward as needed for our portfolio, records, and legal/tax purposes.
- Payment/transaction records: retained as required for tax, accounting, and anti-fraud purposes (Stripe also retains transaction records to meet its own legal and anti-money-laundering obligations).
- Photos: Anomalous Designs may retain photos it takes indefinitely as part of its archive and portfolio, consistent with our Terms.
- Newsletter data: kept until you unsubscribe or ask us to delete it.
8. Your Privacy Rights
We honor privacy rights consistent with applicable law. Depending on where you live, you may have the right to:
- Access/know what personal information we hold about you;
- Correct inaccurate personal information;
- Delete personal information (subject to exceptions, such as records we must keep for legal, tax, or archival purposes, and photos we retain under our Terms);
- Opt out of marketing emails (use the unsubscribe link in any newsletter, or contact us);
- Data portability where required by law.
To exercise any right, contact us at Howdy@AnomalousDesigns.com. We will verify your request and respond within the timeframe required by applicable law (generally 45 days under US state privacy laws). We will not discriminate against you for exercising your rights.
9. California Residents (CCPA/CPRA)
If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the CPRA, gives you certain rights, which we extend as a matter of practice.
Categories of personal information we may collect: identifiers (such as name, email, IP address); California customer records (such as name, phone, billing details); commercial information (such as products/services purchased); internet or other electronic network activity; geolocation (approximate, derived from IP); audio, visual, or similar information (such as photographs); professional or employment information (for business clients); and inferences. We do not intentionally collect sensitive personal information beyond what you voluntarily provide.
Your California rights: the right to know/access, the right to delete, the right to correct, the right to opt out of the sale or sharing of personal information, the right to limit the use of sensitive personal information, and the right to non-discrimination for exercising your rights.
We do not sell or share your personal information for cross-context behavioral advertising, and we do not currently use any trackers that would trigger "sharing" under California law. To exercise your rights, contact us at Howdy@AnomalousDesigns.com.
10. Other US State Privacy Rights
Residents of states with comprehensive consumer privacy laws — including Colorado, Connecticut, Virginia, Utah, and others — may have rights to access, correct, delete, obtain a portable copy of, and opt out of certain uses of their personal information. We extend the core rights described in Section 8 to all users regardless of state.
Idaho, where we are based, does not currently have a comprehensive consumer data privacy law. Idaho residents are protected mainly by the Idaho Security Breach Notification Act and the Idaho Consumer Protection Act, enforced by the Idaho Attorney General. We still honor the rights described above for Idaho residents as a matter of good practice.
11. Visitors Outside the United States
Our Services are intended for US-based users, but our public portfolio is accessible globally. If you access the Services from the EU/EEA or UK, please note that your information will be processed in the United States. Where the GDPR or UK GDPR applies, our lawful bases for processing are typically your consent (for example, newsletter signup), performance of a contract (for example, fulfilling a booking or photo order), and our legitimate interests (for example, operating and promoting our business). You may have rights to access, correct, delete, restrict, or object to processing, and to data portability; contact us to exercise them.
12. Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn we have collected such information without verifiable parental consent, we will delete it. If you believe a child under 13 has provided us personal information, contact us at Howdy@AnomalousDesigns.com. If a minor is photographed as part of a session, a parent or legal guardian must provide consent and any applicable release. We also do not knowingly sell or share the personal information of consumers under 16.
13. Data Security
We use reasonable technical and organizational measures to protect personal information, and we rely on reputable providers (Base44, Stripe, Cal.com, Kit) that maintain their own security programs, including encryption of payment data by Stripe. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
14. Data Breach Notification
If a data breach affecting your personal information occurs, we will notify affected individuals as required by the Idaho Security Breach Notification Act and any other applicable law.
15. Changes to This Policy
We may update this Privacy Policy from time to time. We will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect means you accept the updated Policy.
